Downsizing in Education poses Legal Risk to K-12 School Districts

Teacher downsizing heightens the requirement for School Districts to comply with Federal Rules of Civil Procedure regarding Email and document retention.

Coast to coast, states are struggling to balance their budgets and K-12 teachers are taking the hit, ultimately impacting students and the education and welfare of the nation. Most major metropolitan newspapers have reported that 10,000+ teachers have or will receive pink slips within each of their communities. Layoffs will exacerbate the problem that most K-12 school districts have not yet implemented Email archiving solutions that comply with newly enacted Federal Rules of Civil Procedure (FRCP), mandating the retention of Email and documents for eDiscovery and public record searches. Without automated retention capabilities, Email will be lost with departing teachers and will not be recoverable if Districts are sued for any reason.

?I think one of the reasons that none of us had a solution in place to provide historical Emails, was because all the solutions that were available were so costly and so complex,? said Andrew Shonk, IT Coordinator, Rootstown Public School. ?We knew here we had to get something in place for compliance, so I investigated available Email archiving solutions.?

?November of 2008, Waterford announced a special Email Archiving $99 pricing offer to K-12, including unlimited mailboxes, Email capture and indexing, and full text searching of messages and attachments,? said Tom Politowski, President of Waterford Technologies. ?Rootstown took advantage of that offer and they were glad they did. Now with the increasing threat of Email loss stemming from teacher layoffs, Waterford is re-extending the $99 price promotion to any K-12 School District in North America through the month of May 2009.?

?The need for Email archiving is universal, and as a result, all of the solutions out there are priced accordingly (i.e. priced high),? said Shonk. ?And maybe some of them are priced a little higher than they really should be. That makes it real difficult for K-12 schools to be able to afford it. And there are a lot of times that we see specials aimed at us that don?t really materialize to be legitimate. I have been shocked and happy that Waterford?s $99 special to help out schools was legitimate. It would be very tough for us to have to pay fines, when we could have purchased MailMeter Archive for $99 and prevented it.?
